When we say “Same Day Flowers”, “we”, “us” or “our”, we mean Same Day Flowers Ltd.
These Terms & Conditions apply to your use of our website and to orders placed with us.
Our Privacy Policy explains how we process personal information.
By placing an order, you confirm that:
you are at least 18 years old;
the information you provide is accurate and complete; and
you are authorised to use the payment method provided.
You are responsible for checking the delivery address, postcode, recipient details, delivery date, card message and any delivery instructions before submitting an order.
We may be unable to complete a delivery where the information provided is incomplete, inaccurate or inaccessible.
Flowers and plants are natural and seasonal products.
Colour, size, shape, stem length, bloom stage and the exact appearance of an arrangement may vary from photographs shown on our website.
Product photographs are intended as a guide to the overall style, colour and character of an arrangement rather than a guarantee that every individual stem shown will be included.
Some flowers may be supplied partly or fully in bud so that they open after delivery and have a longer vase life.
All products are subject to availability.
Availability may vary according to:
season;
location;
delivery date;
local florist stock; and
market availability.
If a product cannot be supplied as ordered, we may offer an appropriate substitution in accordance with section 4.
If no suitable alternative can reasonably be provided, we will contact you and may offer another product or a refund.
Because flowers are seasonal and availability differs between florists and locations, substitutions may sometimes be necessary.
A florist may substitute flowers, foliage, containers or packaging where required by availability.
Where a substitution is made, we will aim to:
preserve the overall style and colour palette of the arrangement;
use suitable replacement flowers or materials; and
provide an arrangement of equivalent or greater overall value.
Minor substitutions may be made without contacting you where reasonably necessary to complete the order.
Where a major substitution would materially change the overall character of the ordered product, we will try to contact you where reasonably practicable.
If a suitable alternative cannot be provided, we may offer another product or refund the affected order.
Orders are prepared and delivered by florists serving the relevant delivery area.
Same-day delivery is available only:
for eligible products;
to eligible delivery areas;
on available delivery dates; and
when the order is placed before the applicable cut-off time shown on our website.
Availability can vary by postcode, date and florist capacity.
Unless we expressly confirm otherwise, delivery times are estimates.
We will make reasonable efforts to deliver on the selected delivery date, but we do not guarantee a particular delivery time.
Events outside our reasonable control may affect delivery, including:
severe weather;
road closures;
traffic disruption;
strikes;
transport disruption;
emergencies; and
other circumstances affecting florist or courier operations.
Where this happens, we will take reasonable steps to complete the delivery or contact you regarding the available options.
For deliveries to locations such as:
hospitals;
hotels;
offices;
schools;
care homes;
universities; and
other managed premises,
delivery to reception, security, a concierge, mail room or another authorised person at the premises may constitute successful delivery.
The recipient may be subject to that premises' own rules regarding acceptance and distribution of deliveries.
Where appropriate, a florist may leave an order:
in a reasonably secure location at the delivery address; or
with a neighbour or authorised person.
This may occur where the recipient is unavailable and the circumstances reasonably allow it.
Where possible, delivery information will be provided to the customer or recipient.
You are responsible for providing an accurate and complete delivery address.
If delivery cannot be completed because:
the address is incorrect or incomplete;
access to the property is unavailable;
the premises refuse delivery;
the recipient cannot be located; or
the delivery instructions are inaccurate,
we will take reasonable steps to resolve the issue.
Where a second delivery attempt is required because of incorrect customer-provided information or circumstances outside our control, an additional delivery charge may apply.
This does not affect your statutory rights where the failed delivery was caused by us.
When you submit an order, you are making an offer to purchase the products from Same Day Flowers Ltd.
A contract is formed when we accept your order and send an order confirmation.
An automated acknowledgement that we have received your order does not necessarily mean that the order has been accepted.
Please contact us promptly if you notice an error in your order confirmation.
We may refuse or cancel an order where:
payment is not authorised;
incorrect pricing has occurred;
delivery information is incomplete;
the requested product or delivery cannot reasonably be fulfilled;
we reasonably suspect fraud or unauthorised payment use; or
there has been an obvious website or technical error.
If we cancel an order after payment has been taken and no products have been supplied, we will issue the appropriate refund.
Prices are shown in pounds sterling (£).
Any applicable VAT and delivery charges will be displayed during checkout before you place your order.
Prices and promotional offers may change from time to time.
Changes will not affect an order that we have already accepted, except where there has been an obvious pricing error.
Payment must be authorised before an order can be fulfilled.
Payments are processed through our payment service providers.
Please contact us as soon as possible if you wish to change or cancel an order.
We will make reasonable efforts to accommodate your request, but changes or cancellations may not be possible once:
flowers have been ordered or allocated;
the florist has begun preparing the arrangement;
the product has been personalised;
the order has been dispatched; or
delivery has started.
Fresh flowers, plants and other products that are liable to deteriorate or expire rapidly are generally excluded from the normal statutory 14-day change-of-mind cancellation right applicable to many distance purchases.
Accordingly, once preparation has begun, we may be unable to accept a change-of-mind cancellation for fresh or perishable products.
Products that are made to your specifications or clearly personalised may also be excluded from the normal change-of-mind cancellation right.
This may include products containing personalised messages, where applicable.
Where your order contains non-perishable goods that are covered by statutory cancellation rights, those rights remain unaffected.
Nothing in this section limits your rights where goods are faulty, damaged, not as described or otherwise fail to meet legal requirements.
If there is a problem with an order, please contact us as soon as reasonably possible.
Where relevant, please provide:
your order number;
details of the problem; and
clear photographs showing the issue.
Prompt notification helps us investigate issues with the fulfilling florist.
We aim for flowers to arrive fresh and, with appropriate care, to last up to 7 days from delivery.
Actual vase life varies depending on:
flower variety;
stage of bloom;
room temperature;
water quality;
care;
location; and
environmental conditions.
Our freshness promise is an additional customer-service commitment and does not limit your statutory consumer rights.
Depending on the circumstances, we may offer:
a replacement;
redelivery;
a partial refund; or
a full refund.
The appropriate remedy will depend on the nature and extent of the problem.
If we fail to deliver an order because of an error for which we are responsible, we will offer an appropriate remedy, which may include redelivery at no additional charge or a refund.
Approved refunds are normally returned to the original payment method.
The time taken for a refund to appear in your account may depend on your bank or payment provider.
Nothing in these Terms affects your statutory rights.
Under applicable UK consumer law, goods supplied to consumers must, where relevant:
be of satisfactory quality;
be fit for their usual or agreed purpose; and
match their description.
Any rights or remedies provided by law remain available regardless of anything stated elsewhere in these Terms.
Flowers and plants are natural products and some may:
cause allergic reactions;
cause skin irritation; or
be harmful if eaten.
Some flowers and plants can also be toxic to animals.
For example, lilies can be particularly dangerous to cats.
If allergies, children or pets are a concern, you are responsible for checking whether a particular product is appropriate for the recipient's circumstances.
We may refuse, cancel or delay an order where we reasonably suspect:
fraudulent activity;
unauthorised payment use;
identity misuse;
abuse of promotions;
misuse of the website; or
other unlawful activity.
We may request additional information reasonably necessary to verify an order or payment.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or limits liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
breaches of statutory consumer rights that cannot legally be excluded; or
any other liability that cannot legally be limited or excluded.
Subject to the above, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
Loss or damage is foreseeable where it was obvious that it would happen or where both you and we knew, when the contract was formed, that it might happen.
We are not responsible for losses that are not reasonably foreseeable.
If you are purchasing products as a consumer, we do not exclude liability for losses you suffer as a result of our breach where the law does not permit us to do so.
We are not responsible for delay or failure caused by events outside our reasonable control where we have taken reasonable steps to reduce the impact.
These events may include:
severe weather;
natural disasters;
strikes or industrial action;
transport or road disruption;
power or communications failures;
government restrictions;
emergencies;
acts of terrorism; or
similar events outside our reasonable control.
If such an event affects an order, we will take reasonable steps to contact you and provide appropriate options.
Nothing in this section removes rights you may have under applicable consumer law.
The text, photographs, graphics, branding, logos, website design and other content on our website are owned by or licensed to Same Day Flowers Ltd unless otherwise stated.
You may use the website for your personal, non-commercial use.
You may not reproduce, copy, publish, distribute, sell, commercially exploit or create derivative works from our website content without our prior written permission, except where permitted by law.
We process personal information in accordance with applicable data protection legislation, including the UK GDPR and Data Protection Act 2018.
Please read our Privacy Policy for information about:
what personal information we collect;
how we use it;
who we share it with;
cookies and analytics;
retention; and
your data protection rights.
We may update these Terms from time to time.
The Terms applicable to an order are the version in force at the time we accept that order.
Changes to these Terms will not retrospectively alter an existing accepted order unless required by law or agreed with you.
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as removed to the minimum extent necessary.
The remaining provisions will continue to apply.
If we delay enforcing any provision of these Terms, that does not mean we have waived our right to enforce it later.
Unless these Terms expressly state otherwise, a person who is not a party to the contract has no right to enforce any term under the Contracts (Rights of Third Parties) Act 1999.
These Terms and any contract between you and Same Day Flowers Ltd are governed by the laws of England and Wales.
If you are a consumer resident in another part of the United Kingdom, you may also have rights under the mandatory laws applicable where you live and may be entitled to bring proceedings in the courts of that jurisdiction.
Nothing in these Terms removes any mandatory legal protections available to you as a consumer.
